Terms and Conditions

1. Acceptance of Terms

By accessing or using Sankalpa Guru ("Platform," "we," "us," or "our"), you ("User") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, you must immediately discontinue use of the Platform. These Terms constitute a legally binding agreement between you and Sankalpa Guru Technologies Private Limited.

2. Eligibility

You must be at least 18 years of age to use this Platform. By agreeing to these Terms, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into a binding contract under the Indian Contract Act, 1872.

3. Description of Services

Sankalpa Guru provides the following services:

  • Pandit Booking Services: Facilitation of bookings between Users and independent Pandit Partners for religious ceremonies, pujas, and rituals.
  • AI Purohit: An AI-powered spiritual guidance assistant based on digitised Vedic texts.
  • Panchang & Muhurat: Astrological calendar calculations, muhurat recommendations, and Vedic almanac data.
  • Subscriptions: Premium membership tiers granting access to enhanced features.
  • Jyotish & Horoscope: Birth chart analysis and astrological insights for informational purposes only.

4. Pandit Partner Relationship

Pandits listed on the Platform are independent contractors, not employees, agents, or representatives of Sankalpa Guru. The Platform acts solely as an intermediary marketplace. Sankalpa Guru makes no representations regarding the qualifications, certifications, or competence of any Pandit Partner beyond the verification process described in our Pandit Onboarding Policy.

5. Bookings and Payments

  • All bookings are subject to Pandit availability and confirmation.
  • Payment is processed at the time of booking. Sankalpa Guru holds funds in escrow until the service is confirmed as completed.
  • Sankalpa Guru charges a platform commission (currently 12%) on all Pandit Bookings. This commission is deducted before funds are released to the Pandit.
  • You agree not to circumvent the Platform by directly transacting with Pandits discovered through the Platform for a period of 24 months.

6. Astrological & Spiritual Guidance Disclaimer

All astrological readings, muhurat calculations, Jyotish analyses, and AI Purohit responses are provided for informational and entertainment purposes only. They do not constitute professional, medical, financial, legal, or psychological advice. Sankalpa Guru expressly disclaims any liability for decisions made in reliance upon such guidance. You acknowledge that astrological outcomes are inherently uncertain and non-deterministic.

7. Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Sankalpa Guru Technologies Private Limited, its officers, directors, employees, Pandit Partners, agents, licensors, and successors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • (a) Your use of or reliance upon any astrological prediction, muhurat recommendation, AI Purohit response, or Jyotish analysis provided through the Platform;
  • (b) Your violation of these Terms or any applicable law or regulation;
  • (c) Your breach of any representation or warranty made herein;
  • (d) Any dispute between you and a Pandit Partner arising from a booking or ritual service;
  • (e) Any content you submit, post, or transmit through the Platform.

This indemnification obligation shall survive the termination of your account and these Terms.

8. Force Majeure

Sankalpa Guru and its Pandit Partners shall not be liable for any failure or delay in performing their obligations where such failure or delay results from causes beyond their reasonable control, including but not limited to:

  • Acts of God, including floods, earthquakes, storms, or other natural disasters;
  • Epidemics, pandemics, or public health emergencies;
  • Traffic congestion, road closures, hartals, bandhs, or civil unrest;
  • Severe weather conditions preventing travel to the ritual location;
  • Government orders, lockdowns, curfews, or regulatory interventions;
  • Power failures, internet outages, or telecommunications disruptions;
  • Religious observances or auspicious days preventing scheduling.

In any Force Majeure event, Sankalpa Guru will endeavour to facilitate rescheduling. Refund eligibility in Force Majeure situations is governed by our Refund Policy.

9. Intellectual Property

All content on the Platform, including but not limited to bhajan lyrics, mantra transcriptions, Vedic texts (in digitised form), Panchang data, astrological algorithms, user interface designs, graphics, logos, software code, and written descriptions, is the exclusive property of Sankalpa Guru Technologies Private Limited or its licensors, protected under the Copyright Act, 1957 and applicable intellectual property laws.

You are expressly prohibited from:

  • Reproducing, distributing, or publicly displaying any Platform content without prior written consent;
  • Scraping, crawling, or data-mining any portion of the Platform;
  • Reverse-engineering any algorithms, calculations, or software components;
  • Creating derivative works based on Platform content.

Personal, non-commercial use is permitted solely for the purpose of accessing the services described herein.

10. User Conduct

You agree not to:

  • Upload false, misleading, or defamatory content;
  • Impersonate any person or entity;
  • Use the Platform for any unlawful purpose;
  • Interfere with the security or integrity of the Platform;
  • Post any content that is sexually explicit, violent, or discriminatory.

11. Privacy

Your use of the Platform is also governed by our Privacy Policy, incorporated herein by reference. By accepting these Terms, you also accept our Privacy Policy.

12. Limitation of Liability

To the maximum extent permitted by law, Sankalpa Guru's total liability to you for any claim arising out of or related to these Terms or the Platform shall not exceed the greater of (a) the total fees paid by you to Sankalpa Guru in the three months preceding the claim, or (b) INR 1,000 (One Thousand Rupees).

Sankalpa Guru shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, loss of data, or goodwill, whether in contract, tort, or otherwise.

13. Termination

Sankalpa Guru reserves the right to suspend or terminate your account at any time, with or without notice, for any violation of these Terms or for any reason Sankalpa Guru deems appropriate. Upon termination, your right to use the Platform immediately ceases.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of India. Any dispute arising from these Terms shall first be subject to a mandatory 30-day good-faith negotiation period. If unresolved, disputes shall be referred to binding arbitration under the Arbitration and Conciliation Act, 1996, seated in Pune, Maharashtra. The language of arbitration shall be English.

15. Modifications

Sankalpa Guru reserves the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 7 days before taking effect. Continued use of the Platform after changes constitutes acceptance.
